شروط الاستخدام وسياسة الخصوصية

تشكل هذه الاتفاقية عقدًا ملزمًا قانونيًا بينك (“المستخدم” أو “أنت” ) وبين شركة يلا غو! تكنولوجيز ذات المسؤولية المحدودة (“الشركة” أو “يلا غو!” أو “نحن” أو “لنا”). تُنظم هذه الاتفاقية وصولك إلى منصتنا الرقمية (“المنصة”) واستخدامك للخدمات المقدمة من خلالها – بما في ذلك خدمات النقل (التوصيل من خلال سائقي الرحلات) بالإضافة إلى الخدمات غير المتعلقة بالنقل مثل خدمات التوصيل (الطعام، والبقالة، والطرود، وغيرها من الخدمات حسب الطلب) (“الخدمات”). باستخدامك للمنصة، فإنك توافق على الالتزام بهذه الشروط وسياسة الخصوصية الخاصة بنا. إذا كنت لا توافق على هذه الشروط، يرجى التوقف عن الاستخدام على الفور.
تشمل هذه الشروط:
خدمات النقل: الربط بين الركاب ومقدمي خدمات النقل المستقلين (“السفير” “السفراء” الكابتن” أو “الكباتن”).
الخدمات غير المتعلقة بالنقل: تشمل خدمات التوصيل (للطعام، والبقالة، والسلع، وغيرها)، والحلول الرقمية للدفع، وغيرها من الخدمات.
ممارسات الخصوصية: كيفية جمع بياناتك الشخصية واستخدامها وتخزينها وحمايتها.
باستخدامك للمنصة، فإنك توافق صراحةً على جميع الأحكام الواردة في هذه الاتفاقية، بما في ذلك السياسات التكميلية الخاصة بالخدمات المعينة. لا يوجد في هذه الاتفاقية تكرار إلا حينما يكون ذلك ضروريًا لتطبيق أحكام متشابهة على كلا النوعين من الخدمات.
الشركة / يلا غو!: شركة يلا غو! تكنولوجيز ذات المسؤولية المحدودة.
المنصة: موقعنا الإلكتروني وتطبيقات الهواتف المحمولة والموارد الإلكترونية ذات الصلة التي تمكنك من الوصول إلى خدماتنا واستخدامها.
المستخدم / صاحب الحساب: أي فرد يقوم بالتسجيل واستخدام المنصة.
خدمات النقل: الخدمات التي تمكن المستخدم (الراكب) من ترتيب خدمة نقل مع “السفير” المستقل.
الخدمات غير المتعلقة بالنقل: الخدمات مثل خدمات التوصيل (للطعام، والبقالة، والطرود، وما إلى ذلك)، وحلول الدفع داخل التطبيق، والخدمات الأخرى ذات الصلة المقدمة عبر المنصة.
السفراء: متعاقدون مستقلون يقدمون خدمات النقل و/أو التوصيل. هم ليسوا موظفين أو وكلاء لدى يلا غو!.
الشريك: الشركات الخارجية (على سبيل المثال، المطاعم، والمتاجر) التي يمكن الوصول إلى منتجاتها أو خدماتها عبر المنصة؛ وقد تنطبق شروط منفصلة مباشرةً بينك وبين هؤلاء الشركاء.
الرسوم: المبالغ (بما في ذلك الضرائب المطبقة) التي توافق على دفعها مقابل الخدمات.
رموز الخصم: الخصومات الترويجية التي، إن تم تقديمها، تخضع لشروط إضافية.
المحتوى: أي نص أو رسومات أو صور أو صوت أو فيديو أو مواد أخرى يتم تقديمها على المنصة.
يجب عليك إنشاء حساب للوصول إلى خدماتنا، وتوافق على تقديم معلومات كاملة ودقيقة ومحدَّثة.
يجب أن يكون عمرك 18 سنة على الأقل (أو سن الرشد القانوني في منطقتك) وأن تكون قادرًا على تكوين عقد قانوني ملزم.
تكون مسؤولاً بمفردك عن الحفاظ على سرية بيانات اعتماد حسابك وعن جميع الأنشطة التي تتم باستخدام حسابك. يُرجى إعلامنا فوراً في حال الاشتباه في أي استخدام غير مصرح به.
يمكنك استخدام المنصة لأغراض شخصية وغير تجارية فقط.
يجب عليك الامتثال لجميع القوانين السارية وتجنب أي سلوك مسيء أو احتيالي أو ضار. يُحظر بشدة إساءة استخدام المنصة، بما في ذلك المحاولات غير المصرح بها للوصول إلى المنصة أو تعطيلها.
الوساطة: تقوم المنصة بربط الركاب مع “السفراء” المستقلين. تُقدم جميع خدمات النقل بواسطة هؤلاء السفراء، ويتم تكوين عقد مباشر منفصل بينك وبين السفير لتقديم الخدمة الفعلية.
المقاول المستقل: السفراء هم متعاقدون مستقلون؛ لا تعمل يلا غو! على توظيفهم أو السيطرة عليهم أو ضمان أدائهم بخلاف توفير الربط التكنولوجي.
النطاق: تسهّل المنصة أيضًا طلب خدمات التوصيل، بما في ذلك توصيل الطعام، والبقالة، والمستندات، وغيرها من السلع.
قيود البضائع والتي لا يمكن نقلها: بالنسبة لطلبات التوصيل، تشمل العناصر المحظورة النقود، والذهب، والمجوهرات، أو أي سلع ذات قيمة عالية. بالإضافة إلى ذلك، يجب ألا تتجاوز القيمة المُعلنة لأي طلب توصيل 300,000 ليرة
التنفيذ: بحسب الخدمة، قد تتم عملية التوصيل بواسطة السفراء أو مباشرةً بواسطة شريك (توصيل ذاتي). في كلتا الحالتين، تعمل يلا غو! كوسيط تقني فقط، وتكون العلاقة التعاقدية المباشرة مع المزود المستقل أو الشريك.
تعديل الطلب: بمجرد تقديم الطلب، قد لا يكون من الممكن تغيير عنوان التوصيل أو تفاصيل الطلب. يرجى التأكد من صحة جميع التفاصيل قبل الإرسال.
المعالجة: تُعرض الرسوم الخاصة بالخدمات بوضوح في صفحة الدفع، وتكون مستحقة الدفع عبر طرق الدفع المقدمة في المنصة (مثل النقد، وبطاقات الائتمان/الخصم، والمحافظ الرقمية).
التفويض المسبق: في بعض الحالات، قد نقوم بتفويض مبلغ تقديري على طريقة الدفع الخاصة بك لضمان توافر الأموال الكافية.
العروض الترويجية: تُطبَّق أي رموز خصم أو عروض ترويجية وفقًا لشروطها الخاصة ولا يجوز دمجها إلا إذا تم السماح بذلك صراحةً.
المبالغ المستردة والإلغاءات: تكون الرسوم نهائية وغير قابلة للاسترداد عمومًا، ما لم تُلغَ عملية الطلب من قبل يلا غو! وفقاً للظروف المذكورة هنا. في حالة إلغاء الطلب، ستتم معالجة أي مبالغ مستردة بنفس طريقة الدفع المستخدمة في المعاملة الأصلية.
المعلومات التي تقدمها: تشمل بيانات التسجيل، ومعلومات الاتصال، وأي مستندات يتم تقديمها (على سبيل المثال، للتحقق من هوية السفراء).
البيانات الآلية: نقوم بجمع البيانات الناتجة عن استخدامك لخدماتنا، بما في ذلك تحديد الموقع الجغرافي، ومعلومات الجهاز، وسجلات المعاملات، وإحصائيات الاستخدام.
المحتوى الذي ينشئه المستخدم: الرسائل والتعليقات والتقييمات والبيانات الأخرى التي تشاركها عبر المنصة.
تقديم الخدمة: تُستخدم معلوماتك لتشغيل وتحسين خدماتنا، والتحقق من الهويات (لأغراض الأمان والامتثال)، ومعالجة المدفوعات.
التحسين: نقوم بتحليل بيانات الاستخدام لتحسين تجربة المستخدم وتخصيصها.
التواصل: قد تتلقى تحديثات الخدمة والإشعارات والرسائل التسويقية (وفقًا لموافقتك).
الطرف الثالث: قد نشارك بياناتك مع مقدمي الخدمات الموثوق بهم والشركاء فقط لغرض تسهيل تقديم خدماتك. وتكون تلك الأطراف ملزمة تعاقديًا بالحفاظ على سرية البيانات.
الامتثال القانوني: قد نكشف عن معلوماتك إذا استدعى القانون ذلك أو لحماية حقوقنا.
الأمن: ننفذ تدابير تقنية وتنظيمية بمعايير الصناعة لحماية بياناتك، ومع أننا نسعى لحمايتها، إلا أنه لا يوجد نظام إلكتروني آمن بنسبة 100%.
على أساس “كما هو”: تُقدَّم جميع الخدمات على أساس “كما هو” و”كما هو متوفر” دون أي ضمانات، سواء كانت صريحة أو ضمنية، بما في ذلك ضمانات القابلية للتسويق أو الملاءمة لغرض معين أو عدم التعدي.
المزودون من الأطراف الثالثة: لا تضمن يلا غو! أداء السفير أو الخدمات المقدمة من الشركاء من حيث الجودة والاعتمادية.
التحديد العام: لا تتحمل يلا غو! أو الشركات التابعة لها أي مسؤولية عن الأضرار غير المباشرة أو العرضية أو الخاصة أو التبعية الناتجة عن استخدامك للمنصة أو للخدمات.
الحد الأقصى للمسؤولية: وبموجب ما يسمح به القانون، فإن المسؤولية الإجمالية ليلا غو! عن أي مطالبة لا تتجاوز قيمة الرسوم التي تم تحصيلها من المعاملة الأصلية.
توافق على تعويض يلا غو! وشركاتها التابعة ومسؤوليها ومديريها ووكلائها وموظفيها وإبقائها خالية من أي مطالبات أو أضرار أو خسائر (بما في ذلك الرسوم القانونية) ناتجة عن استخدامك للمنصة أو خرقك لهذه الشروط أو مخالفاتك لأي قانون.
القانون الحاكم: تخضع هذه الاتفاقية لتفسيرات قوانين الولاية القضائية المحلية المعمول بها.
تسوية المنازعات: تُحال أي نزاعات تنشأ عن هذه الاتفاقية أو عن الخدمات أولاً إلى آلية وساطة. إذا لم تُحل النزاعات خلال ستين (60) يومًا، تُحل النزاعات عن طريق التحكيم الملزم وفقًا للقواعد المتفق عليها. تُعامل جميع إجراءات التحكيم والوثائق المتعلقة بها بسرية.
التنازل عن الحق في المحاكمة أمام هيئة محلفين: توافق على التنازل عن حقك في المحاكمة أمام هيئة محلفين وعن المشاركة كعضو في أي إجراء جماعي أو ممثلي في أي دعوى تتعلق بهذه الاتفاقية.
التعديلات: تحتفظ يلا غو! بالحق في تحديث هذه الشروط وسياسة الخصوصية في أي وقت من خلال نشر الإصدارات المعدلة على المنصة. يُعد استمرار استخدامك للمنصة بمثابة قبولك للتغييرات.
الإشعارات: يمكن إرسال الإشعارات المتعلقة بهذه الاتفاقية إلى بيانات الاتصال المرتبطة بحسابك.
قابلية الفصل: إذا تبين بطلان أي بند من بنود هذه الاتفاقية أو عدم قابليته للتنفيذ، فإن البنود المتبقية ستظل سارية المفعول.
الاتفاق الكامل: تُعد هذه الوثيقة، مع سياسة الخصوصية وأي شروط تكميلية، الاتفاقية الكاملة بينك وبين يلا غو! بخصوص استخدامك للمنصة.
التنازل/التحويل: لا يجوز لك أو ليلا جو! نقل أو تفويض أي حقوق أو التزامات بموجب هذه الاتفاقية دون موافقة خطية مسبقة.

This Agreement constitutes a legally binding contract between you (“User”, “you”, or “your”) and YallaGo! Technologies Limited Liability Company (“Company”, “YallaGo!”, “we”, “us”, or “our”). It governs your access to and use of our digital platform (the “Platform”) and the services provided through it – including ride‑hailing as well as non‑ride‑hailing services such as delivery, food, grocery, and other on‑demand services (“Services”). By accessing or using the Platform, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please discontinue use immediately.
These Terms cover:
Ride‑Hailing Services: Connecting passengers with independent transportation providers (“Safeers”).
Non‑Ride‑Hailing Services: Encompassing delivery services (for food, groceries, goods, etc.), integrated payment features, and other services.
Privacy Practices: How we collect, use, store, and protect your personal data.
By using the Platform, you expressly agree to all provisions in this Agreement, including any supplemental policies applicable to specific Services. No part of this Agreement is repetitive except where similar provisions apply across both service types.
Company / YallaGo!: YallaGo! Technologies Limited Liability Company.
Platform: Our website, mobile application(s), and related online resources that enable you to access and use our Services.
User / Account Holder: Any individual who registers and uses the Platform.
Ride‑Hailing Services: Services that enable a User (Passenger) to arrange a transportation service with an independent Safeer.
Non‑Ride‑Hailing Services: Services such as delivery (food, groceries, parcels, etc.), in‑app payment solutions, and other related services offered via the Platform.
Safeers: Independent contractors who provide ride‑hailing and/or delivery services. They are not employees or agents of YallaGo!.
Partner: Third‑party companies (e.g., restaurants, stores) whose products or services may be accessed via the Platform; separate terms may apply directly between you and such Partners.
Charges: The fees, inclusive of applicable taxes, you agree to pay in exchange for the Services.
Promo Codes: Promotional discounts that, if offered, are subject to additional terms.
Content: Any text, graphics, images, audio, video, or other materials provided on the Platform.
You must create an Account to access our Services, and you agree to provide complete, accurate, and current information.
You must be at least 18 years of age (or the legal age of majority in your jurisdiction) and capable of forming a legally binding contract.
You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities performed under your Account. Notify us immediately of any unauthorized use.
You may use the Platform for personal, non-commercial purposes only.
You shall comply with all applicable laws and refrain from any abusive, fraudulent, or harmful behavior. Misuse of the Platform—including unauthorized attempts to access or disrupt the Platform—is strictly prohibited.
Intermediation: The Platform connects Passengers with independent Safeers. All transportation is provided by Safeers, and a separate direct contract is formed between you and the Safeer for the actual ride.
Independent Contractor: Safeers are independent contractors. YallaGo! does not employ, control, or guarantee their performance beyond providing the technological connection.
Scope: The Platform also facilitates the ordering of delivery services, including food, groceries, documents, and other goods.
Item Restrictions: For delivery orders, prohibited items include cash, gold, jewelry, or other high‑value items. In addition, the declared value of any delivery must not exceed Lira 300,000.
Fulfillment: Depending on the service, delivery may be handled by Safeers or directly by a Partner (Self‑Delivery). In either case, YallaGo! acts solely as a technology facilitator, and the direct contractual relationship is with the independent provider or Partner.
Order Modifications: Once an order is placed, changes to the delivery address or order details may not be possible. Please confirm all details carefully before submission.
Processing: Charges for Services are clearly stated at checkout and are payable via the payment methods provided on the Platform (e.g., cash, debit/credit cards, digital wallets).
Pre‑Authorization: In some instances, we may pre‑authorize an estimated amount on your payment method to ensure sufficient funds.
Promotional Offers: Any Promo Codes or discounts will be subject to their specific terms and cannot be combined unless expressly allowed.
Refunds and Cancellations: Charges are generally final and non‑refundable unless a cancellation is initiated by YallaGo! under circumstances specified herein. In the case of a cancelled order, any refunds will be processed using the same payment method used for the original transaction.
Information You Provide: Includes your registration details, contact information, and any documents submitted (e.g., for identity verification of Safeers).
Automated Data: We collect data generated by your use of our Services, including geolocation, device information, transaction records, and usage statistics.
User‑Generated Content: Communications, feedback, ratings, and other data you share through the Platform.
Service Provision: Your information is used to operate and improve our Services, verify identities (for safety and compliance), and to process payments.
Enhancement: We analyze usage data to optimize and personalize your experience.
Communications: You may receive service updates, notifications, and marketing communications (subject to your consent).
Third Parties: We may share your data with trusted service providers and Partners solely for the purpose of facilitating your Services. Such parties are contractually obligated to maintain confidentiality.
Legal Compliance: We may disclose your information where required by law or to protect our rights.
Security: We implement industry‑standard technical and organizational measures to safeguard your data. While we strive to protect your information, no online system is completely secure.
“As Is” Basis: All Services are provided on an “as is” and “as available” basis without any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non‑infringement.
Third‑Party Providers: YallaGo! does not guarantee the performance, quality, or reliability of Safeers or Partner‑provided Services.
General Limitation: In no event shall YallaGo! or its Affiliates be liable for indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform or Services.
Cap on Liability: Subject to applicable law, YallaGo!’s total liability for any claim shall not exceed an amount equivalent to our fee from the original transaction.
You agree to indemnify and hold harmless YallaGo! and its Affiliates, officers, directors, agents, and employees from any claims, damages, or losses (including legal fees) arising from your use of the Platform, your breach of these Terms, or your violation of any law.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the applicable local jurisdiction.
Dispute Resolution: Any dispute arising out of or relating to this Agreement or the Services shall first be submitted to mediation. If unresolved within sixty (60) days, disputes shall be resolved by a local binding arbitration in in accordance with mutually agreed‑upon arbitration rules. All arbitration proceedings and related documents shall be kept confidential.
Jury Trial Waiver: You agree to waive your right to a jury trial and to participate as a class member in any litigation related to this Agreement.
Amendments: YallaGo! reserves the right to update these Terms and the Privacy Policy at any time by posting revised versions on the Platform. Continued use of the Platform indicates your acceptance of the changes.
Notices: Any notices required under this Agreement may be sent to the contact details associated with your Account.
Severability: If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will continue in full force.
Entire Agreement: This document, together with our Privacy Policy and any supplemental terms, constitutes the entire agreement between you and YallaGo! regarding your use of the Platform.
Assignment: Neither you nor YallaGo! may transfer or assign any rights or obligations under this Agreement without prior written consent.
